Acceptance of Terms

By accessing or using ThaiDex, you confirm that you have read, understood and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree with these Terms, you must not access, register for or use ThaiDex.

If you use ThaiDex on behalf of a company, store or other organisation, you confirm that you have authority to accept these Terms on its behalf.

About ThaiDex

ThaiDex is a digital platform being developed for the trading card game community in Thailand. It is designed to connect Trainers, Stores, events, collections, missions, rewards and real-world community experiences in one ecosystem.

References to “ThaiDex”, “we”, “us” or “our” refer to the operator of the ThaiDex website, application and related services.

ThaiDex is currently in development and may operate pilot, testing, early-access or pre-release services before a full commercial launch.

Eligibility

You may only use ThaiDex if you are legally able to enter into an agreement under the laws that apply to you.

Users who are below the legal age required to accept these Terms must have permission from a parent or legal guardian. ThaiDex may introduce specific age restrictions for certain features, transactions, events or community functions.

You may not use ThaiDex if your account has previously been suspended or terminated for serious or repeated violations, unless ThaiDex has given written permission.

Trainer Accounts

Trainers may be able to create an account, profile, avatar, collection, wishlist, achievements, badges, missions and other platform activity.

You are responsible for providing accurate information, keeping your login details secure and ensuring that your account is not used by another person without permission.

Trainer names, profile images, avatars, bios and other public profile information must not impersonate another person, misrepresent an affiliation or violate the rights of others.

You must notify ThaiDex promptly if you believe that your account has been accessed without permission.

Pilot Store Accounts

Stores applying for or participating in the ThaiDex Pilot Store programme must provide accurate and current business and contact information.

A Pilot Store account may only be managed by the store owner, an authorised employee or another authorised representative.

Pilot Stores are responsible for the accuracy of their store profile, opening information, location, events, promotions, rewards, product information and any content published through the Store Dashboard.

Pilot status, Founder benefits, badges, rankings, visibility and early-access privileges are subject to continued participation, compliance and platform availability. They do not create ownership rights in ThaiDex.

User Responsibilities

When using ThaiDex, you agree that you will not:

• Provide false, misleading or fraudulent information
• Access or attempt to access another user’s account
• Interfere with the operation or security of ThaiDex
• Use automated scripts, bots, scraping tools or similar methods without written permission
• Manipulate locations, QR scans, missions, rewards, rankings, levels, badges or platform statistics
• Upload malicious software, harmful code or unlawful content
• Use ThaiDex to promote fraud, counterfeit goods or illegal activity
• Violate intellectual property, privacy or other legal rights
• Resell, sublicense or commercially exploit ThaiDex without written permission

You are responsible for your own device, internet connection, data costs, location settings and any other equipment needed to use ThaiDex.

QR Codes & Rewards

ThaiDex may use QR codes, check-ins, purchase confirmations, missions, giveaways, reward claims, digital items, coins, points, badges, levels and similar systems.

QR codes and rewards must only be used for their intended purpose. Users may not copy, reproduce, share, sell, generate, manipulate or repeatedly use a QR code in a way that creates an unfair or unauthorised benefit.

ThaiDex may verify scans, device information, timing, location, store activity and other relevant data to prevent misuse.

Rewards, coins, points, badges, levels, eggs, incubators, tickets and other digital benefits:

• Have no cash value unless ThaiDex expressly states otherwise
• Are not property or legal currency
• May not be sold or transferred unless a feature allows it
• May expire, change, be corrected or be withdrawn
• May be removed when obtained through error, misuse or fraud

Community Rules

ThaiDex is intended to support a safe, respectful and welcoming trading card game community.

You must not use ThaiDex to:

• Harass, threaten, bully or intimidate another person
• Publish hateful, discriminatory, sexually explicit or violent content
• Share another person’s private information without consent
• Impersonate a user, store, organiser or ThaiDex representative
• Promote scams, counterfeit cards, fraudulent trades or misleading sales
• Spam users or send unwanted commercial messages
• Disrupt events, stores, trades, communities or platform functions

Trading, purchasing, selling and meeting other users can involve real-world risks. You are responsible for using good judgement, verifying cards and products, meeting in safe locations and complying with applicable laws.

Intellectual Property

ThaiDex and its original platform design, branding, logos, artwork, interfaces, software, features, text, graphics, badges, icons, systems and other original content are owned by or licensed to ThaiDex and are protected by applicable intellectual property laws.

These Terms give you a limited, personal, revocable, non-exclusive and non-transferable right to access and use ThaiDex for its intended purpose.

You may not copy, reproduce, modify, distribute, publish, reverse engineer, create derivative works from or commercially exploit ThaiDex content or software without written permission.

You retain ownership of content you submit. By uploading or publishing content through ThaiDex, you grant ThaiDex a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt and use that content as reasonably necessary to operate, promote and improve the service.

Pokémon, Pokémon TCG and related names, characters, card images, marks and intellectual property belong to their respective owners. ThaiDex is an independent platform and is not affiliated with, endorsed by or sponsored by The Pokémon Company, Nintendo, Game Freak or Creatures Inc.

Third-Party Services

ThaiDex may use or link to third-party services such as hosting, authentication, storage, mapping, analytics, messaging, payment, social media, app stores, event platforms or external websites.

Third-party services operate under their own terms and policies. ThaiDex does not control and is not responsible for their availability, security, content, products, conduct or business practices.

Your use of a third-party service may require a separate agreement between you and that provider.

Account Suspension & Termination

ThaiDex may investigate suspected violations and may warn, restrict, suspend or terminate access to an account, feature, reward, Store Dashboard or other service.

Action may be taken where we reasonably believe that:

• These Terms have been violated
• Activity is fraudulent, abusive, unsafe or unlawful
• QR codes, locations, rewards or platform systems have been manipulated
• An account creates risk for users, stores, ThaiDex or third parties
• Suspension is necessary to protect the service or comply with law

You may stop using ThaiDex at any time. Account deletion may be requested through the available account settings or by contacting ThaiDex.

Provisions that by their nature should continue after account closure will remain in effect, including intellectual property, disclaimers, liability limitations, indemnification and governing law.

Disclaimer of Warranties

ThaiDex is provided on an “as is” and “as available” basis to the fullest extent permitted by applicable law.

We do not guarantee that ThaiDex will always be available, secure, uninterrupted, error-free or suitable for every device or purpose.

We do not guarantee the accuracy of user, store, event, product, map, location, collection, card, price, reward or third-party information.

Development, pilot and early-access features may contain errors, change without notice or be discontinued.

Limitation of Liability

To the fullest extent permitted by applicable law, ThaiDex will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, business, data, goodwill, rewards, digital progress or opportunities arising from or connected with your use of ThaiDex.

ThaiDex is not responsible for disputes, losses, injuries, counterfeit products, failed trades, purchases, meetings, events, promotions or other interactions between users, Stores, organisers or third parties.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless ThaiDex and its owners, representatives, contractors and service providers from claims, losses, liabilities, damages and reasonable costs arising from:

• Your misuse of ThaiDex
• Your violation of these Terms
• Your violation of applicable law
• Your infringement of another person’s rights
• Content, products, events or promotions you provide

Changes to these Terms

ThaiDex may update these Terms when services, features, business practices, legal requirements or platform risks change.

The updated Terms will be published on this page with a revised update date. Where appropriate, ThaiDex may provide additional notice through the website, application or account contact information.

Continued use of ThaiDex after updated Terms take effect means that you accept the revised Terms.

Governing Law

These Terms are governed by the laws of Thailand, without regard to conflict-of-law principles, unless mandatory law in your place of residence requires otherwise.

Before starting formal proceedings, you agree to contact ThaiDex and make a reasonable attempt to resolve the matter informally.

Subject to applicable mandatory law, disputes arising from or relating to these Terms or ThaiDex will be submitted to the competent courts of Thailand.
